Terms and Conditions
These Terms apply to all contracts for the sale of goods (construction materials, plumbing, electrical, hardware, etc.) supplied by Builderstock LTD to the Customer.
2.1 B2B Transactions: Our primary customer base consists of commercial entities, including social housing contractors and builders. Where the Customer is a business or is purchasing for commercial use, the provisions related to commercial sales and returns apply, and statutory consumer rights may be limited.
2.2 B2C Transactions: Where the Customer is a private individual purchasing goods for personal use, statutory rights under UK consumer legislation (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013) remain unaffected.
3.1 Offer and Acceptance: The display of goods on our website constitutes an invitation to treat. When you place an order, you are making an offer to purchase the goods subject to these Terms. The contract is formed when we dispatch the goods and send you a dispatch confirmation email.
3.2 Product Specification and Accuracy: We take all reasonable care to ensure that the description and specification of our products are accurate. However, minor variations may occur. Due to the technical nature of construction materials, it is the Customer's sole responsibility to ensure that the goods ordered are suitable for the intended application and comply with all necessary building codes and standards.
3.3 Stock Availability: All orders are subject to stock availability. If we cannot supply the goods ordered, we will inform you as soon as possible and offer an alternative or a full refund.
4.1 Pricing: All prices are listed in Great British Pounds (GBP).
4.2 VAT: Unless otherwise stated, all prices shown on the website are exclusive of VAT. VAT will be calculated and added at the checkout stage based on the prevailing UK rate.
4.3 Payment: Payment must be made in full at the time of ordering. We accept payment via credit/debit card, bank transfer and PayPal. If you choose a bank transfer method, good will be dispatched only after the payment is received.
5.1 Collection Only: All orders placed through the Builderstock LTD website are currently for Collection Only from our designated premises. We do not offer a delivery service at this time.
5.2 Collection Location: Goods must be collected from: Unit 86 Roding Road, London, E6 6LS Monday to Friday, between 6:00am to 5:00pm, and Saturday, between 6:00am to 2:00pm.
5.3 Collection Readiness: We will notify you via email when your order is ready for collection. Orders must be collected within 5 working days of this notification.
5.4 Risk and Title:
Risk of damage to or loss of the goods passes to the Customer at the time the goods are loaded onto the Customer's vehicle at our premises.
Title to the goods shall not pass to the Customer until we have received payment in full.
5.5 Inspection on Collection: The Customer or their representative must thoroughly inspect all goods upon collection before leaving our premises. Any shortages, damages, or discrepancies must be reported immediately to our staff. Failure to do so may affect any claims made thereafter.
6.1 B2B Returns (Commercial Customers)
Goods purchased for commercial use are not eligible for return or exchange unless they are faulty, damaged upon collection (and noted immediately), or incorrectly supplied by us.
Any agreed-upon commercial returns may be subject to a restocking fee of [Insert Percentage, e.g., 20%] of the order value, and the Customer is responsible for return shipping costs.
6.2 B2C Returns (Consumer Customers - UK Statutory Right)
If you are a consumer, you have the right under the Consumer Contracts Regulations 2013 to cancel the contract within 14 calendar days without giving any reason. The cancellation period starts from the day after you receive the goods.
The goods must be returned to us in their original, unopened packaging and in a condition suitable for resale. The consumer is responsible for the cost of returning the goods.
We will process the refund within 14 days of receiving the returned goods.
6.3 Faulty Goods (All Customers)
If any goods are found to be faulty or not of satisfactory quality, you must notify us in writing within a reasonable timeframe (as defined by the Consumer Rights Act 2015). We will either repair, replace, or refund the cost of the faulty goods, including reasonable return shipping costs.
7.1 Warranty: We warrant that the goods supplied will correspond with their specification and be free from material defects in material and workmanship for a period defined by the manufacturer's warranty, commencing from the date of collection.
7.2 Limitation of Liability: To the maximum extent permitted by law, Builderstock LTD shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profit, loss of revenue, or increased costs of working, arising out of or in connection with the supply of goods. Our total liability to the Customer in respect of all losses arising under the contract shall not exceed the price of the goods paid by the Customer.
8.1 Governing Law: These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
8.2 Severance: If any court finds that any provision of these Terms is invalid, illegal, or unenforceable, that provision shall be deemed deleted, and the validity and enforceability of the other provisions shall not be affected.
